The only outright ban is FCC 47 CFR § 22.925:
The previous attempt to abolish it, WT Docket No. 13-301, was introduced in 2013 and seems completely abandoned. Looking at the general speed of operations at FCC I find it unlikely anything will happen there in the next year.
There is also FAA 14 CFR § 91.21 which effectively leaves the decision up to the aircraft operator.
